OLYMPIA — A bill signed into Washington law on Wednesday protects people who save babies or pets from hot cars from liability for any damage to that vehicle, so long as certain conditions are met.
To qualify for civil immunity, the person must do the following:
- Determine whether the vehicle is locked or there is no reasonable method for the person or pet to get out of the car without help
- Have a reasonable belief that entry into the car is necessary because the vulnerable person or pet is in danger
- Ensure that law enforcement is notified or 911 has been contacted, before entering the vehicle
- Use no more force than necessary to enter the vehicle and remove the person or pet
- Remain with the person or pet in a safe location reasonably close to the car until first responders arrive
“Domestic animal” is defined as a dog, cat or other animal that is domesticated and may be kept as a household pet. It does not apply to livestock or other farm animals.
“Vulnerable person” means a person under the age of 18 or a person whose ability to provide for their own care is impaired.
